my hubby has been awarded PIP and has a company pension so I know he is not entitled to income based esa but would he be entitled to contribution based esa , read conflicting reports one being if he got it , he could risk losing his PIP !!!

    Hi Scotsfolk,

    Entitlement to contribution based ESA (CESA) is based on your husbands national insurance record. The rules are complicated on this and the only way of finding out for sure is to make a claim. Generally though, he will have had to have worked in the last couple of years.

    There is no risk to your husband's PIP if he makes a claim for CESA. Many people get both PIP and CESA at the same time.

    However if your husband's company pension pays more than £85 per week then his CESA is reduced by half the amount over this limit. So if he gets £105 a week pension then his CESA will be reduced by £10, ie half of the excess figure of £20.

    Hi received my assessment report with points on before receiving letter from dwp what I'd like to know are these the points that will make up my pip benefits or do dwp have the right to alter the points...

    The final decision is with the DWP but normally they will go along with the recommendation of the report
