Hello all, first time on here i hope you can help, I have filled out a esa claim form, i have had a reply. esa.. contributions is unsuccessful. income based esa will be on going with evidence i need to send, All that is ok up to now. My question is please my partner is in fulltime work will esa be denied on that basis. I do not want to go through all that palava if that will be the case. Thanks

ESA(IR) is dependant on income and savings ie. it is a means tested benefit.So if you partner is earning you may not end up with a payment. I assume that ESA was refused due to NI contributions. By claiming ESA(IR) you may get NI credit but I also may be wrong ( I often am )
Subject to getting a more sensible reply you may be advised
a) put your details into ann online benefit calculator
b) seek trained advice from CAM
