    Hi,

    Great news. The LCWRA element of £336 will be backdated to the 4th month of your claim starting from when you sent in your first fit/sick note. This means that if the decision's definitely been made and it's LCWRA then that will be approximately 1 year of backdated money. Check your journal, because the decision letter will be uploaded on there.

    I must admit that was a very quick decision time, from when you received the forms. I'm assuming this was your first work capability assessment?
  • Kayla24Kayla24 Posts: 10Member Connected

    I hope it doesn't take too long to receive your letter regarding payments, this will likely be uploaded to your journal.

    HI,

    I just looked at your other thread here. https://community.scope.org.uk/discussion/62676/lcwra#latest  it says you started sending in fit notes in March 2018? If this is correct then the 1 month backdated money is not correct and you need to speak to your case manager. Backdated money should be paid from the 4th month after you sent in your first fit note.

    Hi @Kayla24. As long as there have been no gaps in your fit notes (not even a day), then it should be backdated to three full assessment periods after you first submitted a fit note. Please let us know how you get on with your work coach, although you might be better off phoning and speaking with you Case Manager as it is them that would deal with this.

    Just had update sayin 3month waitin period is always from when LCWRA was awarded, mine was awarded 20/3/19.
  • poppy123456poppy123456 Posts: 15,031Community champion Disability Gamechanger
    That's most definitely not correct. The 3 month waiting period is from when you sent in your first fit note, providing there were no gaps in your fit notes. The link i posted above is correct.

    I'd advise you to get some face to face advice from an agency near you.

    I think I will have to as that statement was from the payment section. Thanks for support
  • Adrian_ScopeAdrian_Scope Posts: 4,472Administrator Scope community team
    Hi @Kayla24, as @poppy123456 said that's definitely incorrect. It's three months after the first fit note. In practice it's three full assessment periods so sometimes nearly 4 months, but it's definitely not from when you're awarded! Do you have a CAB near you or Welfare Rights?

I've had a letter for my 12 month assessment for the 11th September can someone tell me now I've had a appointment for a assessment will I still get my limited capability payment on 5th September? Do they wait until assessment decision to decide weather you'll still get payments or not

    You will still received the LCW element until a decision's been made on your assessment.

    If the health assessor recommends my next assessment not be for another 18 months is the dwp likely to go with that?

    That's impossible to answer i'm afraid. Some go over, some are contacted before the recommended time. The time given is just a guide, you can be reassessed anytime from 3 months.

    If the letter states you will be receiving lwcra you need to contact them by phone or your online journal or go to your local job centre as you could be missing out on £336 a month

    Hi,

    There's a 3 month waiting period from the time you sent in your first fit note. Then the LCWRA element is paid on the 4th full assessment period. So, it will totally depend on when you sent in your first fit note and when your assessment period is from.
  • christiantayleure4christiantayleure4 Posts: 7Member Listener
    My first sick note was sent in on 2nd of may 2019 so does that mean it should be paid in on this month
  • poppy123456poppy123456 Posts: 15,031Community champion Disability Gamechanger
    When is your assessment period from?
  • phoeiblazephoeiblaze Posts: 32Member Connected
    @christiantayleure4

    They start back payment on the 4th month from your claim. Example: you made claim in February so timeline goes as follows: .

    Month 1. February to March
    Month 2.  March to April
    Month 3. April to May
    Month 4. May to June (backdate starts)

    You won’t get a letter stating what your back payment is. They don’t do that even though letter award letter says it. Calculate the time you are owed back payment as you haven’t said when you made the claim.

    If after calculating, and you are still short, ring them as they may have missed a payment. They did miss one of mines (first payment as system didn’t factor it in) and I called them and the lady I spoke to checked it, saw it was missing and promised to get in in my bank account in a few hours. It was sent an hour later with a note in my UC journal saying it as well.

    @christiantayleure4

    you can hand in sick notes for a year....they won’t backdate until the claim was made and waiting period has passed
  • poppy123456poppy123456 Posts: 15,031Community champion Disability Gamechanger
    @phoeiblaze i'm sorry but that's not correct. The first sick note wasn't sent until 2nd May, which means it doesn't start from February. The waiting period is 3 months from when the first sick note was sent. If given LCWRA then it's paid from the 4th complete assessment period after your first sick note was sent, which means it totally depends on when the assessment period is.

    This is a complete random example.. a claimant has 3 AP periods between 21st June and 20th September. LCWRA element would start from AP 21st September to 20th October, so the extra element would be received in the October payment.

    Hi @christiantayleure4, I hope this answers your query, but if you have anything else you want to know, please don't hesitate to ask.

    Poppy: I think you and phoeiblaze might be saying the same thing. I believe phoeiblaze was using February as an example to explain how it works, rather than trying to say that's when it would start for christiantayleure4.

    @Adrian_Scope @poppy123456

    Lol yup Adrian. I didn't  see when he made the claim itself, only when he put in sick notes.

    Poppy: I used my own claim period as an example which is why I said 'Example' in my posting so he can get an idea if how to calculate.
