Hi, can someone please help me with this question, I filled a esa3 form in, it was for my own claim, I'm in a civil partnership, and we had our own esa claims, they wanted my income back to 2011 until 2014, now thay say my partner was on the right benefit, so I'm not in titled to any back dated money, I'm confused, because we had our own claim, the dwp knew we were together, I suffer with depression and anxiety, this is keeping me awake, as I don't understand the process, thanks to anyone who replys

    Hi,

    I'm assuming at that time you were both claiming Contributions based ESA, is that correct? If so then DWPs calculation that you're not owed any backdated money is correct. This is because you're both receiving ESA in your own right but any income related top up is means tested and your partners ESA is counted as income, this means that you have no entitlement to any Income Related top up on your ESA. Hope this helps.
