Hi Everyone 

I finally had my appeal on 13th March, they permitted a telephone hearing and I’ve had my decision notice today.. 

I was awarded 6 points for Daily Living and 16 points for Mobility so I get Enhanced Mobility but no Daily Living component. 

I believe they have underscored me on the daily living by 2 points - does anyone know if can argue this point or is this outcome the final award I can get? 

I find it all a bit confusing if I’m honest. 

Also do I get any other components as I’m in on ESA in the support group?

    Hi,

    You can't appeal a decision because you believe they under scored you by 2 points. The first thing you need to do is request the statement of reasons and record of proceedings by emailing HMCTS. Once you receive those you need to find someone to take a look to see if they can find the error in law. If no error is found then you won't be able to appeal the decision.

    You recent PIP award will have no affect on your current ESA claim and your ESA amount will remain the same.
    I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.

    Hello and welcome I am pleased to hear you were awarded enhanced rate of mobility but missed out on daily living as Poppy has advised the next step to follow. I wish you luck if you decide to take this any further

    I’ve been fighting for this since November 2018 so I feel to just leave it now I have something and then hopefully when it’s reviewed in November 2021. It’ll correct itself and I’ll get the right entitlements - good luck and thanks again!
