Hi @Geoark, hope youre well. Im ok thank you. Re my work situation: its now been approx 6 weeks since the problem came up and would you believe im none the wiser. Keep getting told something will happen soon i.e the disciplinary meeting but nothing as of yet. Still in the post room. Im no longer too worried in all honesty, ive used the time well, ive spoken to my union rep at unite, been to see citizens advice, spoken to a solicitor who specialises in employment law and read tons of stuff online so im quietly confident i will be ok. I think the reason for the delay is that my employer has failed in multiple areas and a dismissal will open then up to a tribunal case. Ive got a raft of consultants ready to back me up also. Im just waiting on what they do. There really has been no indication on if they are going to proceed to disciplinary or when they are going to proceed. Im still on full pay at the moment. Thank you for checking up on me.

@Nasmamu you seem to be in a better state of mind which is good, as these things can sometimes take a little while to resolve.

It also sounds as if this has been a learning curve for your employer as well, not a bad thing. Hope it gets sorted soon for you with good news.

Hi @Geoark hope youre well. Just wanted to give you an update. I had my disciplinary yesterday 6th December and it went well. My employer admitted failings on their side, i admitted my own failings and it ended with a 12 month final written warning. Its the best i could have hoped for in the circumstances, as you probaby know call avoidance is gross misconduct and therefore had it not been for disability it would have been instant dismissal.  So happy its all over to be honest. Im now still going to remain on off the phone activities for approx 2 months, after the 2 months i need to decide if being on phones is something i can cope with, if not they will look at redeployment. Thank you for your advice and thank you to @CockneyRebel @matilda and @rhinos for your help in the early days of this thread too. Incase i dont post again. Have a fantastic xmas and wonderful new year. All the best.

Hi @Nasmamu thank you for the update and I am delighted that it has finally been resolved for you. I hope they have put something in place to ease the pressure for you to go to the toilet when you need to.

    Have a great christmas.

I am Rian from the Support to Work team here at Scope I have read your query and I would advise you to speak with your line manager before the initial meeting explaining your medical situation. So it will give them the option to make reasonable adjustments for you to be able to do your role effectively with as little impact on your health concerns.

I would also ask your Union rep for a face 2 face meeting prior to your Meeting with your current employer so you are able to explain your medical situation.

Also by doing this it will give your union rep the chance to also research and argue that you have not had the Work space assessments and also they have not taken into account your condition effecting you at different time along with showing no reasonable adjustments has been made.

Call centers are notorious for dismissal on call dropping I understand that this can and does affect business but you need to stop blaming yourself it is there fault they have duty of care to all staff as well as customers and they should have had a desk assembly don’t within the first week of you being at the desk to prevent health issues they should have also done a stress assessment to make sure you are ok to do your job and if they so good at there jobs they would have been approachable and you would have been given a buddy or health passport so that they know your health issues and able to provide help it may be and idea to ask them to take you off auto calling that way you have control over when you take the call we have IVR at my work and have been auto calling removed from my system so I have control over my call to allow me to leave my desk as and when needed the also should not put extra breaks in place it should be flexible breaks so you can take them when needed cause some days you need more breaks than others you can also self ref to occ health and they not allowed to tell managers anything you don’t agree to don’t worry to much even if you lose the job they don’t sound like a good place anyway there is lots of call centres and happy to say not all are bad
