Hi everyone, going to appeal early November with son. He is Diagnosed ASD, ADHD and Dyspraxia. He has been placed in the work preparation group with LCW.
I've submitted substantive evidence regarding his vulnerabilities however after f2f meeting it was decided he could prepare for work.
I've asked the work coach what work they have in mind for him and they have no idea...there are many discrepancies in his statement of reasons and because he can play Xbox games, do general sweeping of the home (I have no idea where this came from) and can use a computer he can prepare for work. After looking at his commitments it's now changed from looking for work for 25 hours a week to no work related requirements.
Hes in supported education with a EHCP.
Now 20 years old.
I'm wondering what our chances are of him winning his appeal.
All his reports state constant prompting, nit been able to stay on task.
Not aware of dangers and doesn't travel anywhere alone.

Hi,Do you mean the assessment report had so many discrepancies? The statement of reasons is given after a Tribunal and not after the face 2 face assessment.71% of those who appear in person have a decision in their favour. Hopefully your son will be one of them. Good luck.I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying. If i see a question that i know the answer to i will try my best to help.

Hi there, the statement of reasons was given after mandatory reconsideration for LCWRA. We go to apoeal on the 7th November

Sorry, yes the assessment report was very contradictive....

Hi @onlygirl
https://www.benefitsandwork.co.uk/employment-and-support-allowance/esa-glossary/1353-support-group-descriptors
descriptors 9-14 here are what I would look at. In addition to this reg 35 states that if it would cause harm to claimant or others to be found to have LCW then should have LCWRA.
Hope this helps!

Thank you very much for your advice Mary, I've gone through the health assessment and linked his Health Care report showing where he needs constant prompting, where he doesn't see dangers and his everyday battles, also changing his routine and the effects this has on him

Hi @onlygirl, first of all well done! If it's not too much trouble I would like to see your submission statement because I'm waiting for my tribunal date and it might help to see it. Thanks a lot!

Great news, well done. I do think the names of the judges should be hidden here though.
