Pip tribunal and claim

Hi all ?  I've got a pip  tribunal  next week I made my claim in September 2018. So this year I made a new claim to pip and was  awardedin march but what confuses me is I still got the same condition I had  in 2018 and was awarded 0 points. But this time on new claim they just rang up my mental health team and did not go for assessment due to the lockdown. I've got  sever mental health issues and was awarded 11 daily and 10 point walking  so is the tribunal going to go against me or not. Thanks ?

Hi @ali901 Welcome to the community Im sorry to hear about your tribunal loss.

In order to take it any further you need to find an error in law to take it to upper level and to do this I recommend you get specialist advice maybe from citizens advice.

The other option is to put in a new application but the outcome is likely to be the same if it is based on the same evidence.

Have a look at the descriptors carefully and see where you think you should have scored more points

Hi @ali901. So sorry to hear your outcome gutted for you as Iv just got my MR in at the moment I know how stressful this process is. I hope you find a way to take it to next level. Good luck and take care.

I am very sorry you lost your appeal. Please don't give up.

Look into errors of law as @janer1967 mentioned and also in the meantime start collecting all the evidence you can to back up your application should you need to reapply.

I highly recommend specialist advice! There are a few charities that employ lawyers to help people with their DLA/PIP application process. If you meet the criteria and are not getting the award; chances are it isn't being presented well enough and with enough evidence.

Do you have a CPN or contact within the mental health services who can write you a report based on how they view your condition? You can get access to all your GP medical notes under GDPR law so you only pay a maximum of £10 for their printing costs.

Another good thing is to keep a 2-week journal, jot down everything that affects you for example if you go without food one evening because you are feeling too low or anxious make sure it is noted. If you have a family member or carer willing they can complete one too because they may see more than you do.

I don't want to present you with too much information all at once, if you have any questions on what I've said please get back to me. You can tag me by typing @ then my user name.

This is not true. Post GDPR all such records are free.
    Thank you for the correction.
