Dear Benefit's advisor
I am currently in receipt of ESA. I am also technically still employed, but I am not working and not being paid any money as my sickness cover with my company has ran out.
If my employers terminate my contract with them, will I be sanctioned by the DWP and loose benefits?
If I terminate my contract will I be sanctioned and loose benefits?

Hi @RSISolutions
From a benefits perspective, if you are in receipt of ESA, you are not expected to work or to look for work, therefore neither you calling it quits with work, nor them calling it quits with you would cause sanction to your benefit (normally ESA is only sanctioned as the result of a failure to comply with tasks/attend appointments specifically set for you by the jobcentre).
Only thing to check is that you won't somehow lose out from an employment perspective - but if you're happy with that then you should be fine.
