Hi @swainy007
Sorry to hear that you have been refused PIP. Suggest that you re-post in 'Ask a benefits advisor' category. -
just want to no what can I do once tribunal refuced me

@swainy007 If you could go back to before you rang it might have been better to stick with what you had as I know from experience of helping my son PIP was a lot easier to get a few years ago than it is now. I suggest you wait a few months during which time you could try and get more medical evidence and then reapply. You would need to be under the mental health team for your panic attacks and depression and then after you've had some appointments ask them for any written evidence that you suffer from these things. Also see your Doctor about the Sciatica and again get medical evidence. Unfortunately even then it might be difficult to get PIP back as the criteria is based on how you are affected by your conditions. Also as @Matilda has said post again in ask a benefit advisor. They'll be around during the week to give you more advice..

I am already with mental heath team me nurse who I see every week went to the tribunal on my behalf as I don't go out much and they still turn me down

For an oral hearing tribunals expect the claimant to appear in person. Which is why they might automatically have not allowed your appeal.
-
so how does that work for people like me that do go out cos of panic attacks ???
-
You could ask for a paper appeal hearing. Or in exceptional circumstances a tribunal will hold a hearing at the claimant's home.
-
how do I go about doing that then matilda
-
I suggest you ask in Ask a benefits advisor category where experts can advise you.

Hi @swainy007,
There is a further appeals process but you will need some specialist legal advice about this. The next step is to appeal to the Upper Tribunal but you can only do this if there has been an error in law. You will need advice about this to determine if there has been an error in law.
Take a look at the pages on our website about 'How to find legal help'.
If you can't find local advice call us at the helpline.
Best wishes
Debbie
